The trial of a 45-year-old Matson man accused of biting through another man's nose and ear had to be aborted on legal grounds today.
Judge Jamie Tabor QC discharged the jury trying Heath Bowden and said there wouold have to be a retrial as a result of his legal ruling.
He apologised to the jurors that they would be unable to see the case through after they had clearly taken a real interest in it.
Mr Bowden, of Norbury Ave, Matson, has denied inflicting grievous bodily harm on Graham Brook outside the Pelican pub in Gloucester on Feb 3rd this year.
Judge Tabor discharged the jury and bailed Mr Bowden until a retrial due to take place next month.
